Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation

The words with initial capital letters have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by or is under common control with a party.

  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to C&C Digs, LLC DBA Dig Depot.

  • Device means any device that can access the Service, such as a computer, cellphone, or digital tablet.

  • Service refers to the Website and any online booking, information, or communications provided through it.

  • Facility refers to Dig Depot’s physical location in Dallas, TX, where indoor recreational activities, parties, and merchandise sales take place.

  • Terms and Conditions (also referred to as “Terms”) mean this agreement that governs the use of the Service.

  • Third-party Social Media Service means any services or content provided by a third party that may be displayed, included or made available by the Service.

  • Website refers to Dig Depot, accessible from https://thedigdepot.com

  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms and Conditions govern the use of the Website and form a binding agreement between You and the Company. They also set out the conditions under which You may book parties, events, and use Dig Depot’s Facility.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

You represent that You are at least 18 years of age. Parents and guardians booking parties or bringing children into the Facility agree to be responsible for supervising their children and ensuring compliance with all safety rules.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with Our Privacy Policy.

Payments and Cashless Facility

Dig Depot is a 100% cashless facility. We accept all major credit and debit cards for online bookings and in-facility purchases. Cash, checks, and money orders are strictly prohibited and will not be accepted under any circumstances.

Facility Use and Waivers

Participation in activities at Dig Depot involves playing with sand, toys, and equipment in an indoor environment. By using the Facility, You acknowledge and accept inherent risks of play, including but not limited to slips, trips, falls, or minor injuries.

A signed liability waiver may be required before entering the Facility. Parents and guardians remain responsible for their children at all times.

SMS Messaging Terms

Dig Depot offers two text-message programs:

  1. Notifications — transactional text messages related to your bookings, purchases, participation, or account, including confirmations, waiver links, and session reminders
  2. Promotions — promotional text messages about seasonal updates, new events, and offers, which you receive only if you separately opt in

Message frequency varies. Message and data rates may apply. Consent to marketing messages is not a condition of any purchase. Reply STOP to cancel at any time. Reply HELP for help or contact us at dig@thedigdepot.com. Carriers are not liable for delayed or undelivered messages. Our handling of your information is described in our Privacy Policy at https://thedigdepot.com/privacy. You may also revoke SMS consent by contacting us at dig@thedigdepot.com. We will honor reasonable opt-out requests as required by law.

Intellectual Property

The Service, Website, and all original content, features, functionality, and branding (including trademarks and logos) are the exclusive property of C&C Digs, LLC and are protected by United States copyright, trademark, and other intellectual property laws. Unauthorized reproduction or commercial use is strictly prohibited.

Our Service may contain links to third-party websites. We are not responsible for the content, policies, or practices of those sites.

Termination

We may terminate or suspend Your access immediately, without notice or liability, for any reason, including violation of these Terms.

Limitation of Liability

To the maximum extent permitted by law, C&C Digs, LLC, its owners, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Website or Service. Liability regarding physical injury, property damage, or participation in activities at the Facility is governed strictly and exclusively by the Dig Depot Release and Waiver of Liability.

”AS IS” and “AS AVAILABLE” Disclaimer

The Website and Facility are provided “AS IS” and “AS AVAILABLE.” We make no warranties that the Website will be error-free or that the Facility will always be available without interruption. We do not guarantee that the sand, toys, or equipment are free of all allergens, contaminants, or risks.

Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

Dispute Resolution and Binding Arbitration

Any dispute arising out of or relating to your use of the Service, the Website, or the Facility shall be governed exclusively by the dispute resolution and binding arbitration provisions set forth in the Dig Depot Release and Waiver of Liability and the Booking and Event Agreement. By using this Website, you explicitly waive your right to a jury trial and agree to resolve all disputes through binding arbitration in Dallas County, Texas.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Failure to enforce any right shall not be considered a waiver.

Changes to These Terms and Conditions

We may revise these Terms at any time. Updates will be posted on the Website, and continued use of the Service after changes take effect constitutes acceptance of the new Terms.
